The new UK vape laws 2026 come into force on Thursday 29 October, and if you’ve been online this month you’ve probably read five different versions of what that means. Some posts say flavours are being banned. Others say every vape deal in the country is disappearing. A few say nothing is changing at all. None of those are quite right.
At White Vape Co we’ve spent the last few weeks reading the actual legislation, the Department of Health and Social Care (DHSC) retailer guidance and the fixed penalty rules, so we can give you a clear, honest picture. This guide explains exactly what the new UK vape laws 2026 change, what they don’t change, which rules are still only proposals, and how our prices will keep working online and in our Totton, Hythe and Holbury shops.
Short version: if you’re an adult vaper, you can still buy your usual kit, pods and e-liquids, and you can still get great value from us. The big changes are about age checks, free giveaways and very large promotional discounts.

What Are the New UK Vape Laws 2026?
The new UK vape laws 2026 come from the Tobacco and Vapes Act 2026. It started life as the Tobacco and Vapes Bill and received Royal Assent on 29 April 2026, becoming the biggest overhaul of vaping rules since the Tobacco and Related Products Regulations (TRPR) arrived in 2016.
The Act doesn’t switch on all at once. It works in two broad ways:
- Rules written directly into the Act – such as the age of sale, proxy purchasing, free distribution and substantial discount offences. These are the rules that start on 29 October 2026.
- Powers for the government to make future regulations – covering packaging, flavour descriptions, product appearance, shop displays, advertising, retail licensing and a product register. Each of these has to be consulted on before it becomes law, so they’ll arrive in stages between 2027 and 2029.
This two-stage design is the main reason there’s so much conflicting information online. Many articles mix up what the new UK vape laws 2026 actually do on 29 October with what the government could do later. Throughout this guide we’ll be clear about which is which.
The government’s stated aim is to cut vaping among children and young people while keeping vapes available to adult smokers who want to quit cigarettes. That second part matters: the new UK vape laws 2026 are not designed to stop adults vaping, and the official guidance still recognises vaping as far less harmful than smoking.
What Changes on 29 October 2026?
According to the DHSC guidance Selling vaping and nicotine products, published in August 2026, five main things change on 29 October. The new UK vape laws 2026 make it an offence to:
- sell any vaping or nicotine product to anyone under 18;
- buy, or try to buy, a vaping or nicotine product for someone under 18;
- give away a vaping or nicotine product (or a coupon for one) where the purpose or effect is to promote it;
- sell a vaping or nicotine product (or a coupon) at a substantial discount where the purpose or effect is to promote it;
- allow these products to be sold to the public through vending machines.
Let’s go through each one in plain English.
18+ Age of Sale for All Vapes and Nicotine Products
Until now, the law in England, Wales and Northern Ireland only made it illegal to sell nicotine vapes to under-18s. Nicotine-free (0mg) vapes and e-liquids sat in a grey area, and nicotine pouches weren’t covered by a consistent age limit at all.
Under the new UK vape laws 2026, that gap closes. From 29 October it’s an offence for any retailer, including online retailers, to sell any of the following to someone under 18:
- nicotine and nicotine-free vapes and e-liquids, including 0mg shortfills;
- nicotine pouches, strips and pearls;
- products made with synthetic (lab-made) nicotine.
Scotland already age-restricted both nicotine and non-nicotine vapes, and now extends that to nicotine products like pouches too.
The guidance is clear that customers should expect to show ID if asked. Regulations setting out the exact age verification steps for England, Wales and Northern Ireland are still to be debated, but retailers will have a defence if they took all reasonable steps. At White Vape Co nothing changes at the till: we already operate Challenge 25 in all three shops and age-verify online orders. If you look under 25, please bring photo ID – it now applies to 0mg liquids and pouches exactly as it does to nicotine vapes.
Proxy Purchasing Ban
Proxy purchasing means an adult buying something on behalf of someone who’s too young to buy it themselves. The new UK vape laws 2026 make it an offence for anyone aged 18 or over to buy, or attempt to buy, a vaping or nicotine product for someone under 18.
Importantly, the offence is committed by the person buying, not just the shop. That means a parent, older sibling or friend picking up a vape for a 16-year-old can personally face a £200 fixed penalty or prosecution. Shop staff are also expected to watch for proxy sales and refuse them – so if our team asks who a product is for, or declines a sale because someone younger appears to be waiting outside, that’s why.
The Free Vape and Free Sample Ban
This is the change most vapers will notice. Under the new UK vape laws 2026, it becomes an offence to give away a vaping or nicotine product, or a coupon for one, to a member of the public where the purpose or effect is to promote it.
The DHSC guidance gives some specific examples of what would be an offence:
- giving away refillable pods as a free gift;
- handing out free samples for customers to try.
It applies in store, online and through third-party promotions, and it applies to adults as well as children – an “18+ only” condition doesn’t make a free giveaway legal. The ban also covers items that promote a vape product without being one, such as a vape-branded charger.
A “coupon” is defined very widely: anything that can be redeemed for a product, service, cash or other benefit, in physical or electronic form. That’s why retailers across the country have had to look carefully at vouchers, promo codes and reward schemes, not just obvious freebies.
The one major exception is for stop smoking services. If a vape shop has a formal arrangement with a public authority – such as an NHS body or a local council’s stop smoking service – and supplies vapes or redeems vouchers within that agreement, there’s a defence. Free vapes for people trying to quit through an official scheme can carry on.
Substantial Discounts: What Counts?
To stop businesses getting round the free sample ban by charging a penny, the new UK vape laws 2026 also ban selling vaping or nicotine products (or coupons) at a substantial discount where the purpose or effect is promotion.
The guidance describes a substantial discount as a price reduction that significantly lowers the cost compared with the product’s standard selling price. Its main example is selling e-liquid, a device or a nicotine product for a nominal sum such as 10p, which it says would likely be an offence.
Crucially, there is no fixed percentage in the guidance. Whether a discount is “substantial” depends on the product, the size of the reduction and how the offer works. And the guidance explicitly says the restrictions do not affect normal discounting practices:
- retailers can still reduce the price of unsold stock as part of normal business;
- bulk and trade discounts may still apply.
So the new UK vape laws 2026 don’t end sales or bulk pricing. What they target is the headline-grabbing “free kit for 1p” style of promotion designed to get people vaping. Existing advertising rules under Part 7 of the TRPR 2016 also continue to apply until the Act replaces them.
Vape Vending Machine Ban
Tobacco vending machines have been banned in the UK for years. The new UK vape laws 2026 extend that ban to vapes, nicotine products, herbal smoking products and cigarette papers. You won’t have seen many vape vending machines here, but the law now prevents them appearing. Machines used only by staff behind the counter, which customers can’t operate, are not affected.
Which Products Are Covered by the New UK Vape Laws 2026?
The DHSC guidance lists two groups of products in scope.
Vaping products
- vape devices, such as vape pens, pod kits and prefilled pod devices;
- substances to be vaped, such as e-liquids, nic salts and nic shots;
- related components such as coils and vape pods.
Nicotine products
- nicotine pouches;
- nicotine strips;
- nicotine pearls;
- any of these made with synthetic nicotine.
Not covered
The restrictions don’t apply to batteries, chargers and electrical leads (which fall under general safety law), unless branded in a way that promotes a vape product. Licensed medicines and medical devices, such as nicotine replacement therapy patches and gum sold as medicines, are also outside the new UK vape laws 2026.
Penalties and Enforcement Under the New UK Vape Laws 2026
Trading Standards in England, Wales and Scotland, and local councils in Northern Ireland, enforce the new rules. For the first time they can issue fixed penalty notices (FPNs) on the spot rather than having to take every case to court.
| Offence | Fixed penalty (England, Wales, Scotland) | If prosecuted |
|---|---|---|
| Selling to an under-18 | £200 | Up to £2,500 (level 4) in England, Wales and Scotland; up to £5,000 in Northern Ireland |
| Proxy purchasing for an under-18 | £200 | Up to £2,500 in England and Wales; up to £5,000 in Scotland and NI |
| Free distribution or substantial discount | £200 | England and Wales: up to 12 months’ prison and/or a fine on summary conviction; unlimited fine and/or up to 2 years on indictment |
Northern Ireland’s fixed penalty is planned at £250, subject to Assembly approval. Persistent offenders face tougher measures too: in England and Wales, a retailer who commits relevant offences three times within two years can be banned from selling these products, or from selling them at a particular premises, for up to 12 months.
The size of those penalties – especially the possibility of prison for illegal giveaways – shows how seriously the government is treating the promotion side of the new UK vape laws 2026. It’s why responsible shops have reviewed every offer they run.
What Is NOT Changing on 29 October
Clearing up the myths is just as important as explaining the rules. Here’s what the new UK vape laws 2026 do not do on 29 October.
Vape flavours are not being banned
Your favourite berry, dessert, menthol and tobacco e-liquids are still on sale after 29 October. A UK-wide consultation on packaging, flavour descriptions, device appearance and shop displays closed on 2 October 2026, but no decision has been published yet. The proposals focus mainly on how flavours are named and packaged – for example limiting names that reference sweets or desserts – rather than removing flavours from sale.
Plain packaging and hidden displays are still proposals
You may have read that vapes will have to be sold in plain white packs and hidden behind the counter. Those ideas were part of the consultation, but they are not part of the new UK vape laws 2026 that start this month. Any final rules will need regulations and a lead-in period for businesses.
Adults can still buy vapes online and in shops
Nothing in the new UK vape laws 2026 stops an adult buying vapes, e-liquids, pods or pouches online or in store. You’ll just see more consistent age checks.
Disposable vapes were already banned
The single-use disposable vape ban came in on 1 June 2025 under separate environmental law. It’s not part of the 29 October changes. Rechargeable, refillable devices and prefilled pod systems remain legal and widely available.
The generational smoking ban is about tobacco, not vapes
From 1 January 2027, tobacco can’t be sold to anyone born on or after 1 January 2009. That rule applies to tobacco products only. Vapes stay at an 18+ age of sale.
Vape Duty and Duty Stamps: The Other October Change
October 2026 brought two separate changes, which is another source of confusion. As well as the new UK vape laws 2026 from the Tobacco and Vapes Act, the Vaping Products Duty started on 1 October 2026 under tax law.
- The duty is £2.20 per 10ml of vape liquid, plus VAT on top – roughly £2.64 per 10ml in total.
- It applies to nicotine and nicotine-free liquid, including the liquid inside prefilled pods.
- Hardware such as kits, coils, tanks, empty pods and batteries is not taxed.
- From 1 April 2027, every vaping product sold in the UK must carry a duty stamp.
At White Vape Co, stock bought before 1 October stays at its pre-duty price until it sells out, and each product moves to its duty-paid price only when we restock it. You can browse our e-liquids to see what’s still at pre-duty prices. It’s worth remembering that higher shelf prices on e-liquid are caused by tax, not by the new UK vape laws 2026.

White Vape Co Bundle Prices After 29 October: Still Online and In Store
This is the question our customers have asked us most: “Are White Vape Co deals finishing because of the new UK vape laws 2026?”
No. Our bundle prices are staying – online at whitevapeco.uk and in all three of our Southampton-area shops. What’s changing is how we describe and structure them, so everything we offer sits comfortably within the new rules.
From “deals” to bundle prices
The DHSC guidance confirms that normal discounting and bulk discounts can continue. Our mix-and-match prices have always been exactly that: a lower price per bottle when you buy several at once. From 29 October you’ll see them described as bundle prices or multi-buy prices rather than promotional “deals”, for example:
- 10ml e-liquids – bundle price: 5 for £10
- 10ml e-liquids and nic salts – bundle price: 4 for £10
- Nic salts – bundle price: 4 for £12
- Device and e-liquid packages at a combined bundle price
You choose the products, you pay for every item, and the bundle price simply reflects buying in quantity. What you won’t see from us any more is anything given away free, “free gift with purchase” offers, free sample bottles, or products sold for a token amount.
Price match and everyday value
Our price match continues, and we’ll keep pricing competitively across Vampire Vape, Mix Labs, Doozy, Ox Passion, OXVA, Vaporesso and the rest of our range. Fair everyday pricing has never relied on giveaways.
VIP Vape Club and the app
Our VIP Vape Club and White Vape Co app are carrying on. Because the new UK vape laws 2026 define “coupons” so widely, we’ve reviewed how points are earned and redeemed to make sure the scheme fits the new guidance. If anything about how your points work changes, we’ll tell members directly before it happens.
No free samples – but plenty of free advice
We can no longer hand out free tasters of e-liquid. What we can do is talk you through any flavour in detail, explain how it vapes in different devices, and help you pick the right nicotine strength. That advice is free, and it always will be. Pop into our Totton, Hythe or Holbury stores and ask the team.
Quitting smoking? Our Smoke Free Hampshire partnership continues
As an official Smoke Free Hampshire partner, we work with the local stop smoking service. The new UK vape laws 2026 specifically allow vapes and vouchers to be provided through arrangements made by a public authority, so eligible service users can still redeem stop-smoking vouchers with us under that scheme. If you want to quit, contact Smokefree Hampshire or ask in store.
Shopping online after 29 October
Ordering from us online works exactly as before. Add your products to the basket, and any bundle price is applied automatically when you reach the right quantity. We still dispatch the same day on orders placed before 3pm Monday to Saturday, and UK delivery stays free on orders over £30. If you prefer to see the range in person, every product on the website is also available to order through our shops, and our team can check stock across all three branches for you.
Age checks online and in store
We’ll continue to verify age on every online order and operate Challenge 25 in every shop. Under the new UK vape laws 2026, that now covers 0mg e-liquids and nicotine pouches as well as nicotine vapes, so please have ID ready.
Practical Tips for Adult Vapers
- Carry ID. If you look under 25, expect to be asked – including for 0mg liquid and pouches.
- Never buy for under-18s. Under the new UK vape laws 2026, you personally can be fined.
- Use bundle prices to save. Buying several 10ml bottles or pods at once is still the best way to cut your costs.
- Consider a refillable kit. A refillable pod kit gives you full control over flavour and strength, whatever happens with packaging rules later.
- Note your favourite flavours. If names or packaging change in future, knowing the brand and product will help you find them again.
- Be wary of “free vape” offers. After 29 October, a genuine free vape outside an official stop smoking scheme is a red flag.
- Check official sources. GOV.UK guidance is the best place to confirm what the new UK vape laws 2026 actually say.
New UK Vape Laws 2026: Frequently Asked Questions
1. When do the new UK vape laws 2026 start?
The main retail rules start on 29 October 2026 across England, Scotland, Wales and Northern Ireland. The Tobacco and Vapes Act itself became law on 29 April 2026, with further rules expected between 2027 and 2029.
2. Are vape flavours being banned in the UK?
No, not on 29 October. The new UK vape laws 2026 don’t ban any flavours. The government has consulted on limiting flavour descriptions and packaging, but no final decision has been published.
3. Do I need ID to buy a nicotine-free vape?
Yes, if you’re asked. From 29 October, 0mg vapes and e-liquids are 18+ across the UK. White Vape Co runs Challenge 25, so anyone who looks under 25 will be asked for photo ID.
4. Are nicotine pouches covered by the new UK vape laws 2026?
Yes. Nicotine pouches, strips and pearls can only be sold to adults aged 18 and over, and free giveaways of them are banned.
5. Can vape shops still offer deals after 29 October?
Yes. Normal discounting, clearance of unsold stock and bulk discounts can continue. What’s banned is giving products away free to promote them, and selling at a substantial promotional discount such as a token 10p price.
6. Will White Vape Co still have multi-buy prices?
Yes. Our bundle prices continue online and in our Totton, Hythe and Holbury shops. We’ve updated how they’re described and checked how they work so they fit the new UK vape laws 2026.
7. Can I still get a free sample of e-liquid?
No. Free samples and free gifts of vape products are banned from 29 October, whether in store or online. Our staff can still describe flavours and give free advice.
8. Can I still get a free vape to help me quit smoking?
Yes, through an official stop smoking service. The new UK vape laws 2026 allow free vapes and vouchers supplied under arrangements made by a public authority, such as Smokefree Hampshire.
9. What is the fine for selling a vape to someone under 18?
A £200 fixed penalty in England, Wales and Scotland, or a fine of up to £2,500 if prosecuted. Northern Ireland’s penalties are higher.
10. Is it illegal to buy a vape for my 17-year-old?
Yes. Buying a vape or nicotine product for anyone under 18 is proxy purchasing, and the adult buyer can receive a £200 fixed penalty or be prosecuted.
11. Are the new UK vape laws 2026 why e-liquid prices went up?
No. Price rises on e-liquid come from the Vaping Products Duty, which started on 1 October 2026 at £2.20 per 10ml plus VAT. That is a tax change, separate from the 29 October rules.
12. Will vapes have to be sold in plain packaging?
Not yet. Plain packaging, device colour limits and hidden displays have been consulted on but are not part of the 29 October changes. Any final rules will come later through regulations.
Final Thoughts on the New UK Vape Laws 2026
For most adult vapers, the new UK vape laws 2026 will feel like a tidy-up rather than a revolution. Age checks now cover every vape and nicotine product, adults can be fined for buying for under-18s, and the era of free starter kits and penny promotions is over. Flavours, refillable kits, prefilled pods and fair everyday prices are all still here.
At White Vape Co, our approach hasn’t changed: genuine products, honest advice and good value. Our bundle prices remain available at whitevapeco.uk and in our Southampton-area shops, now presented in a way that fits the new rules. If you’ve got any questions about the new UK vape laws 2026, pop in and ask – we’re always happy to help.
